TERMS AND CONDITIONS

1. INTRODUCTION

These Terms and Conditions ("Terms") outline the agreement between you (the customer) and Service Magnet ("we," "us," or "our") regarding the use of our AI Receptionist service.

2. WHAT WE PROVIDE

Service Magnet is an AI-powered phone answering system that:

  • Answers calls 24/7 on your behalf

  • Collects customer information (name, phone number, email, job details)

  • Books appointments or logs inquiries

  • Sends this information to your ServiceM8 account, email inbox, or other agreed systems

3. YOUR SUBSCRIPTION

Pricing: $440 AUD per month (includes 10% GST)

Billing: We charge at the start of each billing month via Stripe

Payment: You authorize us to charge your provided payment method

Late Payment: If payment fails, we may suspend your service. You'll be notified before suspension.

Cancellation: You can cancel anytime. Your cancellation takes effect at the end of your current billing period. No refunds for unused time.

4. YOUR RESPONSIBILITIES

You agree to:

  • Use Service Magnet only for legitimate business purposes

  • Not use it illegally or to harm anyone

  • Keep your login credentials secure

  • Tell us immediately if someone else accesses your account

  • Ensure you have permission to record calls and share customer data with us

  • Comply with all privacy laws in your jurisdiction

5. WHAT YOU CAN'T DO

You must not:

  • Share your login with others

  • Try to reverse-engineer or copy our technology

  • Use our service to harass, deceive, or defraud anyone

  • Upload viruses or malicious code

  • Overload our systems

6. DATA & PRIVACY

Your Data: You own all business data you upload (your business name, phone number, etc.)

Customer Data: We store customer information collected during calls (name, phone number, email, job details). You're responsible for:

  • Having permission from customers to share their data with us

  • Complying with privacy laws

  • Telling customers their information will be stored and used

Data Storage: Your data is stored on servers in the EU and US (via Retell.ai and Chatdash). We protect it with industry-standard security, but we can't guarantee 100% security.

Data Retention: You can delete customer data anytime. We'll also delete data if your account is closed. We may keep some data for legal/compliance reasons.

Third-Party Services: When you authorize ServiceM8 integration, we send job data to ServiceM8. You're responsible for ServiceM8's privacy practices.

Data Breaches: If we discover unauthorized access to your data, we'll notify you within a reasonable timeframe.

7. INTELLECTUAL PROPERTY

Service Magnet owns all technology, software, and systems. You can't copy, modify, or sell our service.

Any feedback you give us can be used by us without compensation.

8. AVAILABILITY & SUPPORT

We aim for 99% uptime, but occasional outages happen (maintenance, third-party issues). We'll notify you of planned maintenance.

Support is available via email. We respond within 24-48 business hours.

9. LIMITATION OF LIABILITY

We are not liable for:

  • Problems caused by your systems or third-party services

  • Lost profits or business opportunities

  • Data loss or corruption

Our Total Liability: Limited to the amount you paid us in the last 12 months, or $1,000 AUD (whichever is greater)

10. TERMINATION

We can suspend or terminate your service if:

  • You don't pay your bill

  • You breach these Terms

  • You use Service Magnet illegally

You can terminate anytime with written notice. Your access ends at the end of your billing period.

11. CHANGES TO THESE TERMS

We may update these Terms. We'll notify you 30 days in advance. If you disagree, you can cancel before the changes take effect.

12. GENERAL

Jurisdiction: These Terms are governed by Australian law.

Your Rights: Nothing in these Terms affects your consumer rights under Australian Consumer Law.

No Warranty: We provide Service Magnet "as-is." We don't guarantee it will meet all your needs.

Marketing: By signing up, you agree we can list you as a Service Magnet customer. You can opt out anytime.
